1. Warranty Provider
This warranty is provided by Baumann S.r.l., Via Palesega 1, 37010 Cavaion Veronese (VR), Italy, for new Baumann sideloaders and original Baumann spare parts supplied through authorised Baumann dealers and distributors.
2. Warranty Coverage
Baumann warrants that its products are free from defects in materials and workmanship under normal operating conditions and when used for their intended purpose.
Where a defect covered by this warranty is identified during the applicable warranty period, Baumann may, at its sole discretion, repair or replace the defective component or part.
3. Warranty Period
Unless otherwise agreed in writing at the time of purchase:
* New Baumann sideloaders are covered for a period of 12 months from the date of delivery to the end user or 1,000 operating hours, whichever occurs first.
* Genuine Baumann replacement parts supplied separately are covered for a period of 6 months from the date of supply.
* Batteries, tyres, engines and third-party components may be subject to separate manufacturer warranties and conditions.
The applicable warranty period for specific machines, components or options may vary according to local market agreements or contractual arrangements.
4. Conditions of Warranty
This warranty applies only where:
* the machine has been operated in accordance with Baumann operating instructions;
* routine maintenance and servicing have been carried out in accordance with Baumann recommendations;
* only approved fluids, lubricants and consumables have been used where specified;
* service records and maintenance documentation are available upon request;
* repairs have been carried out by Baumann or an authorised Baumann dealer or service partner.
5. Exclusions
This warranty does not cover:
* normal wear and consumable items including, but not limited to, tyres, wheels, filters, brake components, chains, wiper blades, bulbs, seals, hoses and paintwork;
* damage resulting from misuse, abuse, overloading, accidents or impacts;
* operation outside the machine’s rated capacity or intended application;
* damage caused by incorrect storage, transportation or environmental conditions;
* unauthorised modifications or alterations;
* the installation or use of non-approved attachments or components;
* damage resulting from the use of non-genuine replacement parts;
* cosmetic deterioration that does not affect the safe operation of the machine.
6. Warranty Claims Procedure
Any suspected warranty issue should be reported to the authorised Baumann dealer or distributor responsible for the machine as soon as reasonably possible after discovery.
To assist with diagnosis and claim processing, the following information may be requested:
* machine serial number;
* operating hours;
* description of the issue;
* photographs or videos where appropriate;
* diagnostic information or fault codes.
Baumann reserves the right to inspect the machine or component before authorising warranty work.
7. Limitation of Remedy
Baumann’s liability under this warranty is limited exclusively to the repair or replacement of defective parts or components covered by this warranty.
The choice of repair or replacement shall remain solely at Baumann’s discretion.
8. Exclusion of Consequential Loss
To the fullest extent permitted by applicable law, Baumann shall not be liable for:
* loss of production;
* loss of profit;
* loss of contracts;
* downtime costs;
* rental equipment costs;
* transport costs;
* indirect or consequential damages of any kind arising from the use or inability to use the equipment.
9. Territorial Administration
Warranty claims are normally administered through the authorised Baumann dealer or distributor responsible for the territory in which the machine was originally supplied.
10. Statutory Rights
This commercial warranty is provided in addition to any statutory rights available under applicable local legislation. Nothing contained within these terms shall limit or exclude any rights that cannot legally be limited or excluded under applicable law.
11. Amendments
Baumann reserves the right to amend these warranty terms and conditions without prior notice. The terms applicable to a warranty claim shall be those in force at the date of machine delivery.
